LensBooth terms of service and acceptable usage guidelines

1. Agreement & Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding contract between you and LensBooth (LensBooth Official Website), operated by Kishan Naik ("Founder & Sole Operator", "LensBooth", "we", "us", "our"), based in India, governing your access to and use of our virtual photo booth platform, websites, and associated services.

By accessing, browsing, or using LensBooth, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, you must not use LensBooth.

2. Age Eligibility & Guidance for Minors

LensBooth is designed for users who are at least 13 years of age:

• Minors (Ages 13 to 18): If you are between 13 and 18 years of age (or the legal age of majority in your jurisdiction), you represent and warrant that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
• Children Under 13: The service is not directed to children under 13, and children under 13 are not permitted to use the service without verifiable parental consent in accordance with applicable laws.
• Community Spotlight (16+): Submitting photo strips for public display on the website requires being at least 16 years of age (with parental/guardian consent if under 18).

3. Optional Account Registration & Google Sign-In

You can use the core camera and photo booth features of LensBooth without creating an account or signing in. However, to save photo strips to your personal cloud gallery and access them across devices, you may choose to create an account by signing in with Google:

• Google Authentication: When you choose "Sign in with Google", authentication is handled securely by Google. We receive basic profile information (such as your verified email address, display name, avatar, and a unique account identifier) to create and manage your account. LensBooth never collects or stores passwords or Google account access tokens.
• Account Security: You are responsible for maintaining the security of your device and Google Account credentials. LensBooth is not responsible for unauthorized access resulting from compromised user devices or accounts.
• Account Termination & Suspension: We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines, or that engage in abusive or illegal activities.
• Self-Service Account Deletion: You may delete your account and all associated cloud-saved photo strips at any time directly through your Profile Settings ("Delete account"). Deleting your LensBooth account permanently removes all account data and saved strips held by LensBooth, and does not alter or delete your Google Account.

4. Service Availability, Technical Requirements & Compatibility Disclaimers

LensBooth is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

• Service Availability & Maintenance: We strive to provide a reliable and continuous experience, but we do not guarantee uninterrupted, secure, or error-free operation. LensBooth may experience temporary downtime, service degradations, scheduled maintenance, emergency updates, or feature modifications at any time without prior notice.
• Technical & Hardware Compatibility: Proper operation of LensBooth depends on your device hardware, operating system, browser version, webcam/camera support, and camera permissions. While we build to modern web standards, we cannot guarantee compatibility across every browser, older device, or restrictive in-app browser environment.
• Network & Real-Time Connectivity: Real-time features such as Shared Booth rely on peer-to-peer connections, internet connectivity, and network conditions. LensBooth is not responsible for disconnections, lag, or session drops resulting from local network instability or connection failures.
• Third-Party Services: LensBooth utilizes trusted third-party infrastructure and services (such as cloud hosting networks and Google for authentication). LensBooth is not responsible or liable for any interruptions, performance degradation, or failures caused by third-party providers.

5. Free Access, Digital Advertising & Sponsored Features

LensBooth is provided to users free of charge. To sustain high-speed cloud hosting, real-time WebRTC signaling, edge infrastructure, and continuous product development without mandatory subscriptions or paywalls, LensBooth displays digital advertisements and sponsored placements:

• Ad Formats & Placements: Advertisements (including display banners, Multiplex recommendation grids, and optional sponsor offerwalls) appear only across informative articles, tool utility screens, and post-session result layouts.
• Live Camera Privacy Isolation: Active camera feeds, capture countdowns, and real-time video streams are 100% private and ad-free. Camera pixels, video frames, and photos are never shared with advertisers or used for ad targeting.
• Sponsor Modals & Feature Unlocks: Certain optional user actions (such as restarting a photo capture session, uploading custom gallery images, or exporting premium formats) may present a brief sponsor modal or offerwall. Users acknowledge and agree that non-intrusive advertising is an essential component of maintaining LensBooth as a free service for everyone.

6. User Content, Likeness Warranties & Indemnity

You retain full ownership of the photo strips, images, and content you generate on your device ("User Content"). However, by using LensBooth, you represent, warrant, and covenant that:

• Third-Party Consents: You have obtained all necessary express consents, publicity releases, and likeness permissions from every individual who appears in your captured photos, video streams, or submissions.
• Indemnification: You agree to defend, indemnify, and hold harmless LensBooth, its founder, operators, affiliates, and contractors from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your User Content, infringement of third-party privacy/likeness rights, or violation of these Terms.

7. Community Showcase License & Takedowns

If you voluntarily submit a photo strip to our public Community Spotlight:

• Age Minimum: You must be at least 16 years of age (with parental/guardian consent if under 18) to submit photo strips to Community Spotlight.
• Display License: You grant LensBooth a non-exclusive, worldwide, royalty-free, revocable license to host, display, reproduce, and feature that specific submission on our website and official social channels for product inspiration.
• Revocation & Removal: You or any depicted individual may revoke this license and request removal at any time by contacting support@lensbooth.app or filing a request on our Contact Page.

8. Prohibited Content & Intermediary Compliance

In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and international standards, you agree that you will NOT host, display, upload, modify, publish, transmit, or share any content that:

• Belongs to another person and to which you do not have any right;
• Is harmful, harassing, defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, bodily privacy, or non-consensual in nature;
• Consists of Child Sexual Abuse Material (CSAM) or any exploitation of minors (Zero Tolerance - immediately reported to NCMEC and cyber law enforcement);
• Infringes any patent, trademark, copyright, or other proprietary/likeness rights;
• Impersonates another person or deceives/misleads the addressee about the origin of the message;
• Threatens the unity, integrity, defense, security, or sovereignty of any nation, or public order;
• Contains software viruses, malicious code, or automated scraping scripts designed to interrupt or compromise the platform.

9. Copyright & Content Takedown Requests

LensBooth acts as an online intermediary facilitating user-generated photo creation and sharing. If you believe your copyrighted work or likeness has been featured on LensBooth without authorization, please submit a written takedown notice containing:

• Identification of the copyrighted work or personal likeness claimed to have been infringed;
• Exact URL or identifying details of the material to be removed;
• Your name, address, telephone number, and email address;
• A statement that you have a good faith belief that use of the material is not authorized;
• A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the owner.

10. Limitation of Liability

To the maximum extent permitted by applicable law, LensBooth, its founder, operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, profits, goodwill, or business interruption arising out of or in connection with your access to, use of, or inability to use the platform.

11. Consumer Rights Savings Clause

Nothing in these Terms of Service shall limit, exclude, or modify any statutory consumer rights, warranties, or remedies that cannot be lawfully waived, restricted, or excluded under the mandatory consumer protection laws of your country of residence (such as the Australian Consumer Law, UK Consumer Rights Act 2015, EU consumer protection directives, or applicable US state consumer protection statutes).

12. Governing Law & Dispute Resolution

These Terms and any dispute, controversy, or claim arising out of or relating to them, their subject matter, or your use of LensBooth shall be governed by and construed in accordance with the laws of India, without giving effect to any conflict of laws principles.

• Informal Resolution: Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, question, or grievance informally by contacting us at support@lensbooth.app or via our Contact Page.
• Jurisdiction: Subject to applicable consumer protection laws that may grant you mandatory rights in your country of residence, you agree that any legal action or proceeding arising out of or related to these Terms or the service shall be subject to the jurisdiction of the competent courts located in India.

13. Changes to Terms & Entire Agreement

We reserve the right to modify or update these Terms at any time. When changes are made, we will update the version number and effective date at the top of this page. Your continued use of LensBooth following the posting of revised Terms means that you accept and agree to the changes. These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and LensBooth regarding the service.
