LensBooth terms of service and acceptable usage guidelines

1. Agreement & Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding contract between you and LensBooth (LensBooth Official Website), operated by Kishan Naik ("Founder & Sole Operator", "LensBooth", "we", "us", "our"), based in India, governing your access to and use of our virtual photo booth platform, websites, and associated services, including Solo Booth, Duo Booth, Instant Cards, Community Spotlight, and LensBooth Studio creative keepsakes (such as Letters, Cassette voice messages, and Tiny Radio).

By accessing, browsing, or using LensBooth, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. If you do not agree to these Terms, you must not use LensBooth.

2. Age Eligibility & Guidance for Minors

LensBooth is a general-audience service for users who are at least 13 years of age:

• Using LensBooth (13+): You must be at least 13 years old to use LensBooth. The photo booth itself (Solo Booth, Duo Booth, photo strips and instant frames) processes your photos on your own device and does not save them to our servers.
• Features that save personal data (18+): Google sign-in and saving strips to your cloud gallery, Tiny Radio broadcasts, Studio Letters, Studio Cassettes, and Community Spotlight submissions are only for users who are at least 18 years old. By using these features, you confirm that you are 18 or older.
• Children: LensBooth is not directed to children under 13, and they are not permitted to use it. If we learn that someone under 18 has used a feature that saves personal data, or that a child under 13 has used LensBooth, we will delete their personal data.

3. Optional Account Registration & Google Sign-In

You can use the core camera and photo booth features of LensBooth without creating an account or signing in. However, to save photo strips to your personal cloud gallery and access them across devices, you may choose to create an account by signing in with Google:

• Google Authentication: When you choose "Sign in with Google", authentication is handled securely by Google. We receive basic profile information (such as your verified email address, display name, avatar, and a unique account identifier) to create and manage your account. LensBooth never collects or stores passwords or Google account access tokens.
• Account Security: You are responsible for maintaining the security of your device and Google Account credentials. LensBooth is not responsible for unauthorized access resulting from compromised user devices or accounts.
• Account Termination & Suspension: We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines, or that engage in abusive or illegal activities.
• Self-Service Account Deletion: You may delete your account and all associated cloud-saved photo strips at any time directly through your Profile Settings ("Delete account"). Deleting your LensBooth account permanently removes all account data and saved strips held by LensBooth, and does not alter or delete your Google Account.

4. Service Availability, Technical Requirements & Compatibility Disclaimers

LensBooth is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

• Service Availability & Maintenance: We strive to provide a reliable and continuous experience, but we do not guarantee uninterrupted, secure, or error-free operation. LensBooth may experience temporary downtime, service degradations, scheduled maintenance, emergency updates, or feature modifications at any time without prior notice.
• Technical & Hardware Compatibility: Proper operation of LensBooth depends on your device hardware, operating system, browser version, webcam/camera support, microphone support, and camera permissions. While we build to modern web standards, we cannot guarantee compatibility across every browser, older device, or restrictive in-app browser environment.
• On-Device Camera & AR Processing: Visual filters, virtual backgrounds, green screen effects, and background blur operate entirely on your device inside your web browser. Camera pixels and video frames are never transmitted to our servers for visual effects or background rendering.
• Network & Real-Time Connectivity: Real-time features such as Duo Booth, Build Together, and LensBooth World rely on direct browser-to-browser (peer-to-peer) connections, internet connectivity, and network conditions. LensBooth is not responsible for disconnections, lag, or session drops resulting from local network instability or connection failures.
• Third-Party Services: LensBooth utilizes trusted third-party infrastructure and services (such as cloud hosting networks, automated safety screening services, and Google for optional authentication). LensBooth is not responsible or liable for any interruptions, performance degradation, or failures caused by third-party providers.

5. Free Access, Google AdSense Ads & Offerwall

LensBooth is provided to users free of charge. To sustain high-speed cloud hosting, live session connections, edge infrastructure, and continuous product development without mandatory subscriptions or paywalls, LensBooth shows Google AdSense ads and the Google AdSense offerwall:

• Ad Partner: Google AdSense is our only advertising partner. It delivers all ads and the offerwall on LensBooth. Ads appear only on browsing pages, articles, Studio tools, and post-session result screens.
• Live Camera & Microphone Isolation: Active camera feeds, capture countdowns, microphone audio recordings, and real-time video streams are 100% private and ad-free. Camera pixels, audio waveforms, video frames, and personal photos are never shared with advertising networks or used for ad targeting.
• Offerwall: Certain actions (such as saving or retaking a photo strip, or using Studio Letters and Cassette) may present the Google AdSense offerwall, which may offer a choice such as viewing a short ad to continue. Users acknowledge and agree that non-intrusive advertising is an essential component of maintaining LensBooth as a free service for everyone.

6. User Content, Likeness, Voice & Indemnity

You retain full ownership of the photo strips, images, audio recordings, letters, and text content you generate on your device ("User Content"). However, by using LensBooth, you represent, warrant, and covenant that:

• Likeness & Third-Party Consents: You have obtained all necessary express consents, publicity releases, and likeness permissions from every individual who appears in your captured photos, video streams, or submissions.
• Voice & Audio Permissions: For voice recordings created in Studio Cassette or Tiny Radio, or live voice conversations in Duo Booth, Build Together, and LensBooth World, you represent and warrant that you hold all necessary rights to record and transmit the voice and audio. You must never secretly record another person without their informed consent, nor submit synthetic voice clones, deepfakes, or deceptive audio impersonations.
• Input Safety & Integrity: User-submitted text (such as community usernames, letter notes, cassette labels, and radio metadata) must be free of malicious code, phishing links, and deceptive URLs. LensBooth reserves the right to reject or strip URLs and unsafe input patterns.
• Indemnification: You agree to defend, indemnify, and hold harmless LensBooth, its founder, operators, affiliates, and contractors from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your User Content, voice recordings, infringement of third-party privacy/likeness/copyright rights, or violation of these Terms.

7. Studio Keepsakes, World, Build Together, Tiny Radio & Community Showcase

LensBooth provides specialized creative tools for sharing memories and community interactions:

• Studio Letters & Cassettes: Shared letters (up to 12 pages) and digital cassettes (voice messages up to 5 minutes with custom labels and cover photos) are shared via private, unguessable links protected by private, unguessable link keys. Shared letter and cassette assets are hosted ephemerally and are automatically and permanently deleted after 30 days. You may not include spam, advertisements, or malicious links in shared letters or cassette labels.
• LensBooth World (3D Virtual Cities & Group Photo Booths): LensBooth World allows you and up to six friends to explore virtual cities (Bengaluru, New York City, Tokyo) as customized 3D avatars:
  • Avatar looks are saved locally on your device and are never uploaded as personal profiles to our servers.
  • Optional live voice chat connects participants directly between browsers; voice is never recorded or stored on our servers.
  • Landmark photo booths process photo strips locally in your browser. If you choose Spotlight, your strip is visible on the city billboard during your active session.
  • All real-time session links and movements are temporary and are automatically and permanently deleted 1 hour after all participants leave.
• Studio Build Together: Build Together enables two participants to design a collaborative 3D scene in real time via private invite link or 8-character code:
  • Participants can arrange 3D furniture and decor, style walls and floors, and upload up to 6 custom photos per scene for picture frames or custom textures.
  • Optional voice chat connects participants directly between browsers; voice is not recorded or stored on our servers.
  • Build Together sessions and uploaded photos are temporary and are automatically and permanently deleted 1 hour after both participants leave.
  • All content uploaded into 3D scenes (including photo textures) and voice communications remain subject to the Prohibited Content standards in Section 8 below.
• Studio Tiny Radio: Tiny Radio is an anonymous public voice board across FM frequencies:
  • Broadcasts are limited to 60 seconds of spoken voice.
  • All recordings are automatically screened prior to broadcast using automated speech recognition and multi-language safety screening, alongside automated safety filters. Transcripts and audio are processed solely for safety screening and are never used to train AI models.
  • Senders agree to reasonable broadcast frequency limits. Submitting abusive, hateful, or prohibited audio triggers strikes; accumulating strikes will result in an automatic 24-hour block.
  • Listeners may report broadcasts that violate community standards. Reported broadcasts are reviewed by our team, who decide whether they stay on air. A broadcast that reaches 5 reports is taken off air until it is reviewed; reports alone never delete a broadcast.
  • Radio broadcasts do not expire automatically. They stay on the air until listener reports or moderation take them down, when the audio is permanently deleted. To have your own message removed, email support@lensbooth.app.
• Community Spotlight (18+): Submitting photo strips to our public homepage showcase requires being at least 18 years of age. You grant LensBooth a non-exclusive, worldwide, royalty-free, revocable license to host, display, and feature approved submissions. You or any depicted individual may revoke this license and request immediate removal at any time by contacting support@lensbooth.app or via our Contact Page.

8. Prohibited Content & Intermediary Compliance

In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and international standards, you agree that you will NOT host, display, upload, record, transmit, or share any photo, voice recording, letter, or text that:

• Belongs to another person and to which you do not have any right;
• Is harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, bodily privacy, or non-consensual in nature;
• Consists of Child Sexual Abuse Material (CSAM) or any exploitation of minors (Zero Tolerance - immediately reported to NCMEC and cyber law enforcement);
• Contains slurs, hate speech, threats of violence, self-harm encouragement, or severe abuse;
• Solicits personal contact details, off-platform messaging, phone numbers, email addresses, or social media handles ("follow my snap", "DM me on Insta", Telegram/WhatsApp contacts);
• Promotes commercial advertising, spam, cryptocurrency schemes, financial solicitations, promo codes, or links;
• Infringes any patent, trademark, copyright, publicity, or other proprietary rights (including unauthorized broadcast of copyrighted music on Tiny Radio);
• Impersonates another person or deceives/misleads listeners or addressees about the origin of the message;
• Threatens the unity, integrity, defense, security, or sovereignty of any nation, or public order;
• Contains software viruses, malicious code, or automated scraping scripts designed to interrupt or compromise the platform.

9. Copyright, Illegal Content & Takedown Requests

LensBooth acts as an online intermediary facilitating user-generated photo creation and sharing. If you believe your copyrighted work or likeness has been featured on LensBooth without authorization, please submit a written takedown notice containing:

• Identification of the copyrighted work or personal likeness claimed to have been infringed;
• Exact URL or identifying details of the material to be removed;
• Your name, address, telephone number, and email address;
• A statement that you have a good faith belief that use of the material is not authorized;
• A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the owner;
• Evidence that you own the work or are authorized to act for its owner;
• Your physical or electronic signature (a typed full name is acceptable).

How we handle notices: In line with Rule 75 of the Copyright Rules, 2013 (under the Copyright Act, 1957), when we receive a complete written notice we disable access to the identified material within 36 hours and keep it disabled for 21 days. If you do not send us an order from a competent court within those 21 days, we may restore access. We also act on orders from courts and authorized government agencies as required by the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

If your content was removed: If you believe material was removed by mistake or that you have the right to use it, email support@lensbooth.app with the URL, an explanation, and your name and signature. We will share your response with the person who made the complaint and may restore the material as described above.

Repeat infringement: We remove infringing material and may suspend or terminate the accounts and access of users who repeatedly upload material that infringes the rights of others.

Reporting illegal content: Anyone can report content on LensBooth that they believe is illegal, including Tiny Radio messages, Community Spotlight photos and shared Studio links. Use the Report button where one is shown, or email support@lensbooth.app with the link or location of the content, a short explanation of why you believe it is illegal, and your name and email address (you may leave these out when reporting child sexual abuse material). If you report by email, we confirm that we received your report and tell you what we decided.

If we remove or restrict your content: Where we have a way to reach you, we tell you what we removed or restricted, which rule or law it broke, and whether an automated tool was involved. Tiny Radio messages are anonymous, so we cannot contact their senders; a message stopped by the automatic safety check is shown as not published when it is sent. You can ask us to review any decision by emailing support@lensbooth.app.

Contact point for users and authorities: Users, and authorities of the European Union and other countries (including under the EU Digital Services Act), can contact us at support@lensbooth.app. We accept messages in English.

10. Limitation of Liability

To the maximum extent permitted by applicable law, LensBooth, its founder, operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, profits, goodwill, or business interruption arising out of or in connection with your access to, use of, or inability to use the platform.

11. Consumer Rights Savings Clause

Nothing in these Terms of Service shall limit, exclude, or modify any statutory consumer rights, warranties, or remedies that cannot be lawfully waived, restricted, or excluded under the mandatory consumer protection laws of your country of residence (such as the Australian Consumer Law, UK Consumer Rights Act 2015, EU consumer protection directives, or applicable US state consumer protection statutes).

12. Governing Law & Dispute Resolution

These Terms and any dispute, controversy, or claim arising out of or relating to them, their subject matter, or your use of LensBooth shall be governed by and construed in accordance with the laws of India, without giving effect to any conflict of laws principles.

• Informal Resolution: Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute, question, or grievance informally by contacting us at support@lensbooth.app or via our Contact Page.
• Jurisdiction: Subject to applicable consumer protection laws that may grant you mandatory rights in your country of residence, you agree that any legal action or proceeding arising out of or related to these Terms or the service shall be subject to the jurisdiction of the competent courts located in India.

13. Changes to Terms & Entire Agreement

We reserve the right to modify or update these Terms at any time. When changes are made, we will update the version number and effective date at the top of this page. Your continued use of LensBooth following the posting of revised Terms means that you accept and agree to the changes. These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and LensBooth regarding the service.
